The following describes the terms and conditions by which YFARM.COM offers you access to our services.

YFARM.COM may change the User Agreement from time to time. Any changes to the agreement are effective after we provide you with 14 days' notice of changes by posting the changes on our web site and issuance of e-mails to registered users. However, we may choose to temporarily change our policies for special events and such changes are effective when we post a notice of the temporary events on the web site.

Our services are available to individuals and entities that can form legally binding contracts under applicable law. Without limiting the foregoing, our services are not available to minors. If you do not qualify, please do no use our service. YFARM.COM retains the right to refuse service to anyone at any time, at our sole discretion. YFARM.COM may terminate user access or suspend any user's access to all or any part of our site at our sole discretion.

YFARM.COM exists to serve as a system to facilitate the creation of a marketplace for buyers, farmers, ranchers, vendors, carriers and services providers associated with the farm industry. As such, it is not involved in the actual transactions. We, therefore, do not provide any warranty as to the types, quality, size, safety, or legality of products offered for sale. YFARM.COM does not have control over buyers, farmers, ranchers, vendors, carriers and/or services providers in completing the sale or purchase of products or services.

YFARM.COM provides its system and service "AS IS" without any expressed or implied warranty or merchantability. Data provided by the YFARM.COM web site might contain inaccuracies or typographical errors. YFARM.COM does not guarantee the accuracy or reliability of information provided by it's users. If you should have a dispute with one or more of the YFARM.COM registered users, you release YFARM.COM, it's personnel and/or directors from claims, demands, and damages arising out of or in any way connected with such disputes.

To the maximum extent permitted by applicable law, in no event shall YFARM.COM or its personnel and/or directors be liable for any special incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for: loss of profits, loss of confidentiality or other information, business interruption, personal injury, loss of privacy, failure to meet any duty (including of good faith or of reasonable care), negligence, and any other loss whatsoever) arising out of or in any way related to the use of or inability to use the YFARM.COM system and/or services.

Sellers, vendors and service providers agree to: complete all transactions for which you receive an order at the stated price, except in exceptional cases; provide accurate and truthful information concerning products offered for sale on YFARM.COM and to regularly update such information; and to pay all transaction fees, which may be agreed to.

Buyers agree to: complete all transactions for which you place an order with a seller and/or service provider, expect in exceptional cases; and provide accurate and truthful information and to regularly update such information; and to pay all transaction fees, which may be agreed to.

All users agree to not to use any device, software, or routine to: interfere with the operation of YFARM.COM; infringe on any party's intellectual or other proprietary rights or rights of privacy or publicity; violate any state or federal law, statute, or regulation; be defamatory or obscene; or contain any virus or other destructive mechanism.

YFARM.COM agrees to comply with all applicable federal, and state laws and industry standards with respect to the collection and use of personal information from our users. The security of user logins and passwords are the responsibility of our registered users. A user's registered name, company, address, phone number, and inventory may be displayed to other users in the course of conducting business on the system. However, specifics of a users account will not be made available to other users or be sold or distributed.

This agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to conflicts of law provisions. Any dispute or claim in law or equity arising out of or related to this Agreement shall be decided by neutral, binding arbitration and not by court action, except as provided by California law for judicial review of arbitration proceedings.
